چکیده
یکی از روشهای بازنگری در قانون اساسی تغییر آن از طریق روشهایی غیر از روشهای مقرر در متن قانون اساسی است. هنگامی‌که احکام مندرج در اصول قانون اساسی با واقعیات خارجی متفاوت می‌شوند به‌تدریج فاصلهای میان الفاظ و واقعیات پیدا میشود. فرایند فاصله گرفتن لفظ قانون اساسی با واقعیات خارجی را تغییر غیررسمی قانون اساسی میگوییم. گاهی این تغییرات بدون آنکه مصوبهای قانونی در میان باشد معمول و مجری است و گاهی با مصوبهای قانونی رسمیت پیدا میکند. این هر دو صورت به دلیل اجماع و اتفاق اداره‌کنندگان کشور بدون آنکه با مانعی برخورد کند جریان پیدا میکند و همچون الزامی گریزناپذیر خود را بر همه ارکان و اجزاء مملکت تحمیل میکند. اغلب چنین اتفاق میافتد که پیش از آنکه مصوبهای قانونی این تغییرات را کلید بزند، این جابجاییها در باورها و افکار و آمال نشو و نما پیدا میکند و سپس به‌تدریج در بخشهای مختلف و جزئی اجرا میشود تا مبنایی برای اقدامات مهمتر فراهم میکند. بدین ترتیب آرام آرام پیش میرود و راه خود را در تغییر تدریجی اصل باز میکند. تا این‌که روزی در قالب قانون و مصوبهای صورت رسمی به خود میگیرد. در این مقاله با بررسی اصل 44 قانون اساسی ج.ا.ا به‌عنوان یکی از مصادیق این مفهوم ضرورت توجه به این مفهوم را در مطالعات حقوق اساسی یادآوری خواهیم کرد. چنین به نظر می‌رسد که بدون توجه به چنین مفهومی نمی‌توان شناختی دقیق از قانون اساسی ارائه کرد.
