اینستکس، سازوکاری است که از سوی سه کشور اروپایی برای حفظ برجام و ایفای تعهدات این کشورها معرفی شد؛ هرچند در عمل ناکارآمد باقی ماند. این پژوهش، با استناد به روش تحلیلی-تفسیری، چالشهای حقوقی و اقتصادی اینستکس را بررسی میکند. در این راستا، مهمترین چالش حقوقی عبارت است از عدم تطابق مقررات ایران با توصیههای فتف و قرار داشتن در فهرست سیاه و تکلیف کشورهای اروپایی به انجام اقدامات متقابل در مورد کشورهای پُرخطر مطابق توصیه 19. چالشهای حقوقی احتمالی دیگر ناظر به عدم انطباق با مقررات سازمان تجارت جهانی، با توجه به مبتنی بر تهاتر بودن و نیز مغایرت با مقررات دفتر کنترل داراییهای خارجی آمریکا (اوفاک) است. چالشهای اقتصادی نیز در دو سطح خُرد و کلان قابل بررسیاند. عدم هماهنگی با روحیات تاجران، اطلاعرسانی ناکافی و مشکلات ناشی از واحد پرداخت، عدم توازن میان واردات و صادرات، عدم پیشبینی تجارت نفت و احتمال تحریم ثانویه از سوی آمریکا، مهمترین چالشهای اقتصادی هستند. طرحهای مشابه اینستکس برای مقابله با تحریمها همانند ارزهای دیجیتال، برنامه نفت در برابر غذا و ایجاد دفتر کنترل داراییهای خارجی در اتحادیه اروپا نیز هر یک ایرادهایی دارند؛ بهطوریکه درنهایت میتوان گفت بزرگترین چالش اینستکس، چالش سیاسی و خطر تحریمهای ثانویه آمریکا است.
