چکیده

گسترش شهرنشینی، تامین مسکن و توسعۀ ساخت‌وساز یک نیاز است. به همین منظور قانونگذار با ابداع قرارداد پیش فروش ساختمان، ضمن تسهیل دسترسی به مسکن ارزان قیمت، به تأمین مالی پروژه‌های ساختمانی نیز کمک کرد. با این حال قرارداد پیش فروش قرارداد به مثابۀ نهالی است که صرف کاشتن آن بدون اتخاذ تدابیری برای مراقبت و ادارۀ آن، یا آن را می خشکاند. فقدان تعبیۀ یک مدل مدیریتی-نظارتی در فرآیند پیش فروش، یک مسألۀ جدی در روابط پیش فروشنده و پیش خریدار بوده است که می‌تواند منشاء مشکلات عدیده‌ای باشد. لذا پرسش مطروحه آن است که چگونه می‌توان به یک مکانیزم حقوقی مدیریت کارآمد فرآیند پیش فروش دست یافت.
برای پاسخ بدین پرسش، این پژوهش بر مبنای روش جمع آوری اطلاعات کتابخانه ای و مراجعه به اسناد و مدارک، در کنار روش تحقیق توصیفی-تحلیلی، ابتدائا مسألۀ نظارت بر پرداخت‌ها و داوری در اختلافات را به عنوان چالش برانگیزترین مسائل در روابط خریدار و فروشنده دانسته است و در چارچوب مطالعۀ نقش سردفتر در فرآیند پیش فروش در حقوق خارجی و نظریات صاحبنظران در حوزۀ ظرفیت‌های نظام سردفتری، مدلی را برای پاسخ‌دهی به این پرسش براساس مبانی توجیهی مسألۀ نمایندگی در علم اقتصاد و بهره‌برداری از نظریۀ مدیریت پروژۀ پیمانکاری با محوریت نفش سردفتر ارائه داده است
