تاملی بر اصول حقوقی و اقتصادی حاکم بر نظام های پرداخت از منظر سند CPSS

چکیده
نظام های پرداخت ، بخش حیاتی زیرساخت های اقتصادی و پولی هرکشور هستند، که نحوه کارکرد آنها، نقش اساسی در تسویه سریع و کارآمد معاملات، انتقال ایمن وجوه در بخش های مختلف نظام اقتصادی، تقویت و ارتقای کارآیی و افزایش ثبات نظام اقتصادی در عرصه های ملی و بین المللی ایفا می کند. گزارش اصول اصلی حاکم بر نظام های پرداخت مهم سیستمی (CPSS) بانک بین المللی تسویه وجوه (BIS ) مشتمل بر استانداردهای جهانی و اصول دهگانه حقوقی و اقتصادی حاکم بر فرآیندهای نظام های پرداخت است که از مهم ترین ترتیبات مالی و پولی بین المللی در حوزه نظام های پرداخت با هدف تعیین معیارها و اصول بکارگیری و ارزیابی سیستم های پرداخت و سیاست های نظارتی بانک مرکزی بر زیرساخت‌های مالی در کشورهای مختلف جهان است. این سند هم اکنون در نظام های حقوقی و اقتصادی بین المللی به شدت انعکاس و در حوزه های گسترده و متنوع نظام های پرداخت مورد استفاده و توسعه یافته است.

دراین پژوهش تلاش می شود با روش توصیفی و تحلیلی، به معرفی و بررسی این اصول و ابعاد حقوقی و اقتصادی آنها پرداخته شود تا بسترهای لازم به منظور اعمال ، تطبیق و ارزیابی نظام های پرداخت متعدد نظام اقتصادی ایران در چارچوب این اصول فراهم گردد و از این رهگذر شاهد ارتقاء وتوسعه نظام های پرداخت داخلی منطبق با معیارها و هنجارهای بین المللی به روز در حوزه حقوق پرداخت و اقتصاد باشیم.
