تحلیل حقوقی و مقایسه مطلوبیت استفاده از اعتبارات اسنادی قابل انتقال و اتکایی در قراردادهای بین‌المللی

چکیده
اعتبارات اسنادی قابل‌انتقال و اعتبارات اسنادی اتکایی، هریک نقشی اساسی در تأمین مالی قراردادهایی دارند که شخصی به عنوان واسطه میان خریدار اصلی (متقاضی) و تأمین‌کننده قرار می‌گیرد. با توجه به شرایط و ملاحظات موجود، در برخی موارد اعتبارات اسنادی اتکایی و در برخی موارد اعتبارات اسنادی قابل‌انتقال، حمایت بیشتری از حقوق اشخاص دخیل در فرایند اعتبار اسنادی (متقاضی، ذی‌نفع و بانک صادرکننده) دارند. اعتبارات اسنادی قابل‌انتقال دارای مزایایی از جمله کم‌هزینه و سریع‌تر بودن آن است و در مقابل دارای ایراداتی است؛ از جمله اینکه انتقال طولی آن بیش‌تر از یک مرتبه ممکن نبوده و خطر افشای اطلاعات مربوط به تأمین‌کنندگان اصلی، همواره ذی‌نفع نخست (فروشنده) را تهدید می‌کند. در مقابل، گشایش اعتبارات اسنادی اتکایی مستلزم صرف زمان و هزینه‌ بیشتری هستند، لکن با توجه انعطاف قابل توجه آن نسبت به اعتبارات اسنادی قابل انتقال و با عنایت به نقش مؤثری که در محرمانه نگاه داشتن اطلاعات مربوط به تأمین‌کنندگان اصلی دارد، برای برخی فعالان در تجارت بین‌المللی مناسب تلقی می‌شود. در این مقاله با روش تحلیلی – توصیفی مزایا و معایب و ریسک‌ها و چالش‌های موجود در هریک از این اعتبارات اسنادی تحلیل شده و نقاط افتراق نظام حقوقی ایران با مقررات بین‌المللی در این خصوص بررسی شد و مشخص گردید که در شرایط کنونی اقتصاد کشور ایران و وجود محدودیت‌های تجاری و بانکی بر فعالیت بازرگانان ایرانی، استفاده از اعتبارات اسنادی اتکایی در گسترش مبادلات و تأمین امنیت تجاری، تأمین نقدینگی و تسهیل معاملات، مطلوبیت بیشتری دارد.
