مکانیزم تعدیل مرزی کربن اتحادیه اروپا در ترازوی حقوق بین‌الملل: تعارض‌ها و راهبردهای کشورهای در حال توسعه

چکیده
مکانیزم تعدیل مرزی کربن (سی بم) اتحادیه اروپا، به‌عنوان یکی از سیاست‌های نوین در هم‌افزایی اهداف اقلیمی و تجاری، در دسامبر 2023 به تصویب رسید و از آن زمان تاکنون با انتقادات گسترده‌ای مواجه بوده است. این مقاله با روش توصیفی و تحلیلی و بررسی تطبیقی سی بم از دو منظر تعهدات تجاری بین‌المللی و تعهدات اقلیمی، به تحلیل چالش‌های حقوقی این مکانیزم می‌پردازد. این مقاله ضمن بررسی رویه مرجع استیناف سازمان تجارت جهانی، تضاد احتمالی سی بم با اصول بنیادین تجارت جهانی از جمله منع تبعیض و رفتار ملی را بررسی و نشان می دهد که اجرای آن می‌تواند کشورهای فاقد زیرساخت‌های مناسب قیمت‌گذاری کربن را در موقعیت نابرابر تجاری قرار داده و اختلافات بسیاری را رقم بزند. همچنین این مکانیزم از منظر تعهدات اقلیمی و اصل «مسئولیت مشترک اما متفاوت» در نظام حقوقی موافقت‌نامه پاریس تحلیل شده و تأثیرات آن بر کشورهای در حال توسعه تشریح شده است. مقاله در پایان، راهکارهایی از جمله توسعه زیرساخت‌های داخلی، تقویت ظرفیت‌های گزارش‌دهی و مشارکت در مذاکرات بین‌المللی را برای کاهش اثرات منفی سی بم و دستیابی به یک نظام قیمت‌گذاری کربن جهانی پیشنهاد می‌دهد. این پژوهش به دنبال ایجاد تعادل بین الزامات زیست‌محیطی و توسعه پایدار در بستر تجارت جهانی است.
