چکیده

پلتفرم‌های دیجیتال به عنوان بازیگران کلیدی در اقتصاد مدرن، از ویژگی‌های ساختاری منحصربه‌فردی مانند اثرات شبکه‌ای، امکان ارائه خدمات رایگان و توانایی تجمیع و پردازش کلان‌داد‌ه‌ها برخوردار هستند. خصائص مورد اشاره، کاربست معیارهای معمول جهت شناسایی وضعیت اقتصادی مسلط پلتفرم‌های دیجیتال از منظر حقوق رقابت را با چالش مواجه می‌کند. پژوهش حاضر با رویکردی توصیفی-تحلیلی، به بررسی چالش‌های ارزیابی قدرت بازاری و شناسایی وضعیت اقتصادی مسلط پلتفرم‌های دیجیتال از منظر حقوق رقابت می‌پردازد. فرضیه مقاله بر این مبنا استوار است که معیارهای معمول و کلاسیک ارزیابی قدرت بازاری، یعنی سهم بازاری، موانع ورود به بازار و قدرت متقابل کاربران، امکان استخراج معیارهای جزئی و متناسب با ویژگی‌های منحصربه‌فرد پلتفرم‌ها به منظور ارزیابی قدرت بازاری آن‌ها را فراهم می‌آورد. یافته‌های پژوهش نشان می‌دهد که سند «سیاست‌ها و الزامات کلان حمایت از رقابت و مقابله با انحصار» مصوب شورایعالی فضای مجازی، بستری قانونی و قابل استناد برای شورای رقابت فراهم نموده است تا بتواند این معیارهای جزئی را به‌صورت مؤثر به کار گیرد.
