بررسی تطبیقی کشاورزی قراردادی در ایران در راستای بهبود کارایی اقتصادی و توسعه پایدار کشاورزی

چکیده
کشاورزی قراردادی به‌عنوان یکی از ابزارهای نوین در تنظیم روابط اقتصادی میان تولیدکنندگان و خریداران محصولات کشاورزی، نقش مهمی در کاهش ریسک‌های تولید، افزایش بهره‌وری و تأمین امنیت غذایی ایفا می‌کند. یافته‌های این پژوهش نشان می‌دهد که این نهاد در بسیاری از کشورها از طریق قوانین مدون و چارچوب‌های حقوقی شفاف حمایت می‌شود، درحالی‌که در نظام حقوقی ایران، هنوز یک ساختار جامع و مشخص برای آن تدوین نشده است. این مقاله در پاسخ به سوال از خلأهای موجود در زمینه کشاورزی قراردادی در ایران، این فرضیه را مطرح می‌کند که نبود قوانین مدون و شفاف در ایران موجب کاهش امنیت حقوقی طرفین قرارداد، افزایش اختلافات و محدودشدن توسعه این نهاد شده است. این پژوهش با روش تحلیلی-توصیفی و رویکرد تطبیقی، قوانین داخلی و بین‌المللی را بررسی کرده و نتیجه گرفته است که تدوین مقررات جامع، تقویت حمایت‌های قانونی و بهره‌گیری از تجربیات موفق جهانی، موجب ارتقای جایگاه کشاورزی قراردادی در ایران خواهد شد.
