بررسی تطبیقی امکان مطالبه خسارت عدم‌النفع در دعاوی مالکیت فکری در حقوق ایران و کنوانسیون پاریس

چکیده
اشهر اقوال، ضرر و قابل مطالبه شناختن عدم‌النفع مسلم است؛ مع‌الوصف، مقنن در نظام حقوق مالکیت فکری گاه عدم‌النفع را ذیل خسارات برشمرد و گاه خسارات را منحصر در معنای ضرر کرد و نسبت به عدم‌النفع اشاره‌ای نداشت؛ گاه نیز آن را صرفاً ناظر به قسمی خاص از دعاوی مالکیت فکری دانست که همین امر موجب اختلاف، پیرامون قابلیت مطالبه آن گردید؛ بدین وجه که قانون ثبت علائم و اختراعات، خسارات را شامل ضرر و منافعی می‌دانست که زیان‌دیده از آن محروم گردیده‌است؛ لیکن آیین‌نامه‌ قانون ثبت اختراعات، طرح‌های صنعتی و علائم تجاری خسارت را صرفاً ضررهای وارده برشمرد. نهایتاً قانون حمایت از مالکیت صنعتی در باب نقض حق اختراع، منافع ممکن‌الحصولی را که صدق اتلاف می‌نماید ذیل عنوان خسارت إحصاء کرده‌است. ایران همچنین به کنوانسیون پاریس ۱۸۸۳ پیوسته‌است که از مدلول آن استنباط می‌شود که این پرسش در حقوق مالکیت فکری به نظام داخلی دول عضو واگذار گردیده‌است؛ چراکه این معاهده مجموعه‌ای از قوانین مدون ماهوی ندارد که بتواند جایگزین حقوق داخلی شود. نتیجتاً باید بر آن بود که امکان مطالبه عدم‌النفع در دعاوی مالکیت فکری هم مطابق قاعده عمومی حاکم بر نظام حقوقی است و هم از وحدت ملاک باب حق اختراع در قانون مالکیت صنعتی منبعث می‌شود
