ارزیابی حقوق رقابتی موانع ورود در بازارهای دیجیتال با تأکید بر نقش کلان‌داده‌ها

چکیده
بازارهای دیجیتال به‌واسطه‌ی تمرکز فزاینده بر داده و نقش‌محوری کلان‌داده‌ها در فرایند رقابت، با موانع ورود نوظهور و پیچیده‌ای مواجه‌اند. دسترسی نابرابر به داده‌های گسترده و قابلیت تحلیل و بهره‌برداری از آن‌ها، موجب شکل‌گیری مزیت‌های انحصاری برای شرکت‌های جاافتاده و محدودیت‌های جدی برای ورود رقبا می‌شود. از این منظر، موانع ورود در بازارهای دیجیتال صرفاً ماهیتی اقتصادی ندارند، بلکه حاصل تعامل عوامل فنی، رفتاری و ساختاری هستند که در کنار محدودیت‌های قانونی، مانع تحقق رقابت مؤثر می‌شوند. این پژوهش با رویکردی میان‌رشته‌ای، ضمن تحلیل ماهیت و کارکرد موانع ورود در بازارهای دیجیتال، نقش کلان‌داده‌ها را در ایجاد و تقویت این موانع بررسی می‌کند و چارچوب‌های حقوقی مؤثر بر کاهش آن‌ها را ارزیابی می‌نماید. یافته‌ها نشان می‌دهد که تنظیم‌گری مؤثر بر دسترسی و اشتراک‌گذاری داده‌ها، الزام به قابلیت همکاری فنی میان سکوها و حمایت از نوآوری شرکت‌های نوپا، از مهم‌ترین ابزارهای حقوقی برای کاهش تمرکز و ارتقای رقابت در بازارهای دیجیتال است. در نهایت، تأکید می‌شود که تبیین دقیق مفهوم موانع ورود و تدوین قواعد الزام‌آور در حوزه داده، می‌تواند مسیر تحقق رقابت منصفانه و پایداری بازارهای دیجیتال را در نظام حقوقی ایران هموار سازد.
