تحلیلی انتقادی بر گفتمان تقنینی مالیات سبز در ایران با محوریت الزامات کنوانسیون آرهوس(از تقنین پراکنده تا تنظیم‌گری مشارکتی)

چکیده
در جوامع معاصر، حکمرانی محیط‌زیست از الگوهای سنتی فاصله گرفته و به ابزارهای نوین تنظیم‌گری، از جمله مالیات سبز، متکی شده است. مالیات سبز به‌عنوان مالیات پیگویی (Pigouvian)، با هدف درونی‌سازی هزینه‌های جانبی منفی، صرفاً ابزار تأمین درآمد نیست، بلکه سازوکاری برای اصلاح رفتارهای آلاینده و تحقق عدالت زیست‌محیطی است. بااین‌حال، اجرای آن بدون شفافیت، مشارکت عمومی و دسترسی مؤثر به عدالت، می‌تواند مشروعیت و کارآمدی سیاست زیست‌محیطی را تضعیف کند. این پژوهش با رویکرد توصیفی ـ تحلیلی، ساختار گفتمانی و تنظیمی مالیات سبز در ایران را با شاخص‌های بنیادین کنوانسیون آرهوس بررسی و گذار از الگوی «تقنین پراکنده و اجرای اداری» به «تنظیم‌گری مشارکتی» را پیشنهاد می‌کند. یافته‌ها نشان می‌دهد که فقدان تعریف حقوقی منسجم از مالیات سبز و پراکندگی آن میان عوارض، جرایم و سایر ابزارهای مالی، موجب ابهام در ماهیت و کارکرد محیط‌زیستی آن شده است. همچنین، ضعف انتشار نظام‌مند اطلاعات محیط‌زیستی، فقدان سازوکار رسمی مشارکت شهروندان و NGOها در فرایند تقنین و تصمیم‌گیری، و محدودیت دسترسی مؤثر به دادرسی و اقدامات فوری، شکافی اساسی با الگوی آرهوس ایجاد کرده است. بر این اساس، اصلاح چارچوب تقنینی، نهادینه‌سازی شفافیت و مشارکت عمومی، و تقویت تضمین‌های قضایی می‌تواند مالیات سبز را به ابزاری مشروع و پاسخ‌گو تبدیل کند.
